Conditions of Sale

ORDERS are subject to written acceptance by the Supplier. All orders are delivered ex works Hamburg/GERMANY (Incoterms 2010).

QUOTATIONS are firm for acceptance for 30 days and for shipment within 6 months from date of quotation. Time of delivery is subject to due reception of advance payment or L/C.

PRICES are subject to change without notice. Changes in prices do not affect orders confirmed by the Supplier. However, if the shipment is delayed due to late receipt of advance payment or L/C, the prices will be subject to an additional 1,2% per month delay.

DAMAGED GOODS
Goods damaged in shipment are the responsibility of the CARRIER who must be notified by the consignee immediately upon receipt of the goods. All claims must be filed by the consignee, not by the Supplier.

RETURN of GOODS
Unless covered by JÜRGEN PETERS Maschinen und Anlagentechnik GmbH warranty terms, the Supplier only accepts return of goods that is normally stocked and marketable and in need for JÜRGEN PETERS Maschinen und Anlagentechnik GmbH, and after prior consent. Returned goods are subject to a 20 % fee for covering of handling, re-inspection and testing costs.
Returned goods must be shipped prepaid.

PAYMENT is to be made in advance or effected by irrevocable, confirmed Letter of Credit in our favour with COMMERZBANK AG, Hamburg.

PROPERTY RIGHT
Goods supplied remain the property of JÜRGEN PETERS Maschinen und Anlagentechnik GmbH until payment has been received in full.

TECHNICAL CHANGES
The Supplier reserves the right to normal product development and technical modifications.

FORCE MAJEURE
The Supplier has the right to ship later than announced on the occurrence of events beyond his control.

LITIGATION
In the event of litigation, German law applies and jurisdication for both contracting parties is Germany. JÜRGEN PETERS Maschinen und Anlagentechnik GmbH is however at their own choice entitled to take legal proceedings against the purchaser before any relevant court.

WARRANTY
Products are warranted to the original purchaser to be free from defects in material and workmanship for a period of 12 months from date of commissioning or 15 months from date shipped, whichever is sooner. Warranty time as stated above is based on single shift operation.

JÜRGEN PETERS Maschinen und Anlagentechnik GmbH agrees to repair or replace FCA Ahrensburg/GERMANY any part, which proves to be defective due to faulty materials or workmanship during the warranty period, providing the equipment, is unaltered and properly installed, maintained and operated. All parts replaced under warranty must be returned to the Supplier freight prepaid.

Minor adjustments, proper installation, tightening fittings, and instructions how to operate and maintain the product are responsibility of the dealer or installing contractor and are not covered by this warranty.

In case of warranty claim, the product - or faulty part of it - shall be returned to the JÜRGEN PETERS Maschinen und Anlagentechnik GmbH for repair or exchange in our choice. Such products are to be forwarded to the Supplier freight prepaid and are returned freight collect.

This warranty is void if the product is connected to incorrect voltage, frequency, water pressure, air pressure, steam pressure, water temperature, steam temperature, or, where applicable, damaged by operating without water or in any other way operated in discrepancy with the users manual, or in a way that it is beyond its capacity.

GENERAL CONDITIONS
Unless other written agreement is made, the JÜRGEN PETERS Maschinen und Anlagentechnik GmbH Conditions of Sale, the ORGALIME S2000 (or if erection is included the ORGALIME SE01), shall apply in mentioned order.

These comments contain supplementary conditions and amendments to the above general conditions. If there is any contradiction between these comments and the provision of the general conditions, the comments shall apply.
